LIABILITY STATEMENT
The holder of this ticket and/or other admission items (collectively the “Holder”) voluntarily assumes all risks and danger (for both the Holder and/or any minor(s) admitted with Holder with or without a ticket) incidental to BreyerFest of any type or nature, whether natural or man-made, and whether occurring prior to, during, or after the event, including but not limited to the danger of being killed or injured by horses, dogs, or other objects, acts of others, “Acts of God”, etc. and Holder agrees that neither Reeves International Inc. (“Reeves”) nor Breyer nor any of the respective offices, directors, agents, owners, employees, representatives, or volunteer workers of any of the foregoing are liable or responsible for any accident, damage, injury, death or illness to Holder, minor(s), horses, dogs, or other pets, spectators, or any persons or property whatsoever.
There is an inherent and elevated risk of exposure to COVID-19 in any public place or place where people are present and there is no guarantee, express or implied, that those attending BreyerFest will not be exposed to COVID-19. COVID-19 is an extremely contagious disease that can lead to severe illness and death. The CDC advises that some people are more likely than others to become more severely ill than others, and some people are at a higher risk of exposure to COVID-19. Guests should evaluate their own risk in determining whether to attend. By visiting BreyerFest you (Holder) voluntarily assume all risks related to exposure to COVID-19 (for both Holder and/or any minor(s) admitted with Holder with or without a ticket).
Under Kentucky Law, a farm animal activity sponsor, farm animal professional, or other person does not have the duty to eliminate all risks of injury of participation in farm animal activities. There are inherent risks of injury that you voluntarily accept if you participate in farm animal activities.
Holder knowingly and freely assumes all such risks related to injury, illness, infectious disease, harm and loss associated with BreyerFest (for both the Holder and/or any minor(s) admitted with Holder with or without a ticket), including any injury, illness, infectious disease, harm and loss caused by the negligence, fault or conduct of any kind of the foregoing organizations and individuals.
Holder expressly releases and agrees to defend, indemnify, and hold harmless each of the foregoing organizations and individuals from any such claims, damages, suits, causes of action or liability of any type of nature (for both the Holder and/or any minor(s) admitted with Holder with or without a ticket). In the event of injury, Holder should ask for directions or report to the medical services station immediately and/or ask a BreyerFest staffer to call for medical assistance.
BREYERFEST ADMISSIONS (ON SITE)
BreyerFest admission wristband is required for entry (unless under the age of 6 and accompanied by a Holder). BreyerFest tickets, Programs, Parking Passes, Lounge Passes and BreyerFest models/merchandise are non-refundable. Once model redemption tickets are torn, they will no longer be accepted for model pick up.
Holder acknowledges that this event may be broadcast or otherwise publicized, and Holder’s ticket purchase and entry to BreyerFest constitutes Holder’s consent to be photographed, filmed, and/or otherwise recorded by Reeves and/or Breyer, including any minor(s) admitted with Holder with or without a ticket, and for Reeves and/or Breyer to use Holder’s appearance and/or voice, and/or that of any minor(s) admitted with Holder with or without a ticket, in any and all media in perpetuity and without compensation to Holder or such minor(s) for any purpose whatsoever including without limitation commercial and/or promotional use, in connection with BreyerFest, Reeves and/or Breyer.
Reeves reserves the absolute right to deny any individual or entity access to the facilities at the Kentucky Horse Park during BreyerFest, including without limitation if they are a ticket holder. Reeves reserves the right to deny access to anyone who attempts to enter, or enters, the grounds with a wristband, ticket (including without limitation model redemption tickets) obtained through inappropriate sources, and reserves the right to eject anyone who is in violation of Event and/or Kentucky Horse Park rules and regulations or is otherwise engaging in disruptive, disorderly, and/or illegal behavior. Reeves also reserves the right to seize the wristbands and/or tickets without refund or compensation.
Reeves reserves the right to revoke any stated offer, cancel orders, and to correct any errors, inaccuracies or omissions in any stated offer or price, including after an order has been submitted and whether or not the order has been confirmed and your payment processed. Void where prohibited or otherwise restricted by law.
Refunds, if any, are subject to Reeves’ refund policy, the terms of which are incorporated herein by reference and which can be viewed at www.BreyerHorses.com. All rights reserved.
COVID-19 SAFETY INFORMATION (EFFECTIVE 2/1/23; subject to change):
BreyerFest attendees on site event must comply with Reeves, Breyer, Kentucky Horse Park, venue, and Fayette County, Kentucky rules, procedures, and/or requirements related to SARS-CoV2-novel coronavirus/COVID-19. Please visit the Kentucky Department for Public Health Guidance website and this page for current guidelines. Attendance is conditioned on such compliance. Guidelines are subject to change according to then-current public health guidance and applicable law.
- While attending BreyerFest and related events held or sponsored by Reeves, proper Social Distancing (physical distancing of at least 6 feet apart in public settings) is encouraged.
- Face coverings/masks are encouraged for all persons > 2 years of age at all times indoors in crowds and on any Breyer shuttle/trolley service (unless actively eating or drinking), regardless of vaccination status, to reduce the risk of exposure to COVID-19. Face coverings/masks also encouraged in outdoor settings for all persons > 2 years of age in crowds and/or anywhere you are you are unable to maintain adequate social distance. Medically vulnerable guests are encouraged to avoid crowds and/or anywhere you are unable to maintain adequate social distance.
- If you are feeling ill, experiencing symptoms of COVID-19, have tested positive for COVID-19, or have been exposed to a confirmed or suspected case of COVID-19 within the last ten (10) days, and have not been cleared as non-contagious by state and local health authorities or your health care team, regardless of vaccination status, please do not enter BreyerFest, any BreyerFest related venue, and/or the Kentucky Horse Park grounds.
- In addition to any applicable social distancing and/or mask requirements, there will be hand sanitation stations located throughout BreyerFest and the Kentucky Horse Park.
